1.     Introduction

Welcome to The Wendy App ("we," "our," or "us"). This Privacy Policy explains how we collect, use, disclose, and protect information that we gather from users of our app, available on the Apple App Store (the "App"). By using the App, You/Parent/Guardian/Caregiver (hereinafter, “Caregiver” or “Parent”) agree to the collection and use of information in accordance with this Privacy Policy.

Below, we summarize potential instances of data collection and outline how and when we will provide parental notice and/or seek parental consent. If we collect personal information from a child, we will retain that information only as long as necessary to fulfill the activity request or allow the child to continue to participate in the activity and ensure the security of our users and our services, or as required by law. If we discover that we have collected information from a child in a manner inconsistent with COPPA’s requirements, we will either delete the information or immediately seek the Caregiver’s consent for that collection.


2.     Information We Collect

 a.     Caregiver’s Personal Information

We collect personally identifiable information ("Personal Information") from the Caregivers, such as:

-       Registration information you provide when you create an account, such as your first name and surname, country of residence, gender, date of birth, email address, username, and password;

-       Account credentials (username and password);

-       Payment information (if applicable);

-       Transaction information when you request information or purchase a product or service from us, for example, your mailing address, telephone number, and payment information

-       Location information, whether precise or approximate, may be obtained from a mobile or other device interacting with our sites, applications, or physical properties (including through beacon technologies), or associated with your IP address or other online or device identifier, where permitted by law.

When you visit and use our App, open emails we send, or connect with our wireless Internet access services and other similar technologies, we may collect usage, viewing, technical, and device data. This may include information such as your browser or device type, unique device identifier, and IP address.

Regarding the collection of Caregiver email address: In compliance with COPPA requirements, on any website or app targeted at children, or in any instance where we request age information and determine that the user is age 12 or under, we will request a Caregiver email address before collecting any personal information from the child. If you believe your child is engaging in an activity involving personal information collection and you or another Caregiver have not received an email providing notice or requesting your consent, please don't hesitate to contact us at privacy@trywendy.com . We will not use Caregiver emails provided for parental consent purposes for marketing to the Caregiver unless the Caregiver has expressly opted in to email marketing or has separately engaged in an activity that allows for such email contact.

b.    Usage Data

We collect information about your interactions with the App ("Usage Data"), which may include:

-       Device information (e.g., device type, operating system, unique device identifiers)

-       Log data (e.g., IP address, browser type, time and date of access)

-       Usage patterns (e.g., pages or features accessed, duration of use)

c.     Children's Privacy

We are committed to protecting the privacy of children. Our App is designed to comply with the Children's Online Privacy Protection Act (COPPA). We collect Personal Information from children under 13 years of age only with verifiable parental consent. This information may include:

-       Child's name

-       Child's age or birthdate

-       Child's preferences and interests for content personalization

d.    Verified Parental/Caregiver Consent

Email or Pin Code Consent. In the event The Wendy App needs to collect personal information from a child, COPPA requires that we first seek a Caregiver’s consent by email, or via another reasonable authentication method. In the email or pin code authentication pop-up, we will explain what information we are collecting, how we plan to use it, how the Caregiver’s can provide consent, and how the Caregiver’s can revoke consent. If we do not receive Caregiver’s consent within a reasonable time, we will delete the Caregiver’s contact information and any other information collected from the child in connection with that activity.


3.     How We Use Your Information

We use the information we collect for various purposes, including:

-       Providing and maintaining the App

-       Personalizing user experience

-       Communicating with you about updates, promotions, and news

-       Analyzing usage patterns to improve the App

-       Ensuring compliance with legal obligations


4.     Disclosure of Your Information

We do not share your Personal Information with third parties except in the following circumstances:

-       With your consent

-       With service providers who perform services on our behalf

-       To comply with legal obligations

-       To protect our rights and property


5.     Push Notifications

Push notifications are notifications on mobile and other devices that are typically associated with downloaded applications, and which can communicate to the device holder even when the application is not in use. We will require a Caregiver to provide verified consent before the child can receive push notifications from our child-directed applications that collect a device identifier. We will then provide the Caregiver with notice of our contact with the child and will provide the Caregiver the opportunity to prevent further notifications. Finally, we will not associate the device identifier with other personal information without contacting the Caregiver to get consent.


6.     Geolocation Data

We will seek verified Caregiver consent if the app needs to collect geolocation information that is specific enough to equate to the collection of a street address.


7.     Persistent Identifiers

When children interact with us, we may automatically collect certain information to make our applications more interesting and useful for children and for various purposes related to our business. This information may include the type of mobile phone, the child’s IP address or mobile device identifier, the web browser, the frequency with which the child visits various parts of our applications, and information regarding the online or mobile service provider. We may collect this information using technologies such as cookies, flash cookies, web beacons, and other unique identifiers.

The following information may be collected by us or by a third party. This data is mainly used for internal purposes, such as:

- Providing children with access to features and activities on our application

- Customizing content and improving our application

- Conducting research and analysis to address the performance of our application

- Generating anonymous reporting for our use

If we collect (or allow others to collect) such information from children on our application for other purposes, we will notify the Caregiver and obtain consent prior to such collection.


8.     Security

We take reasonable measures to protect your information from unauthorized access, use, or disclosure. However, no method of transmission over the internet or electronic storage is 100% secure.


9.     Caregiver’s Rights

Caregivers have the right to access and review their child's Personal Information, direct us to delete it, and refuse to allow any further collection or use of the child's information. 10.  Generative AI Usage

Our App uses generative AI to create personalized children's content. While we strive to provide enjoyable and accurate content, the AI may occasionally produce stories that are not accurate or contain hallucinations. We recommend that Caregivers review the content to ensure its suitability for their children.


11.  Your Rights and Choices

You may access, update, or delete your Personal Information by contacting us at privacy@trywendy.com You may also opt-out of receiving promotional communications from us by following the unsubscribe instructions in those communications.


12.  Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Effective Date" above.
